Conviction vs. Non-Conviction Data Rules
Washington's Criminal Records Privacy Act, RCW 10.97, applies in Cowlitz County the same as everywhere else in the state. Conviction records, cases that ended in a guilty plea, verdict, or adverse disposition, are public under RCW 10.97.050. Anyone can get them without giving a reason. Non-conviction data covers arrests and charges where no conviction resulted and the case is no longer active. Under RCW 10.97.030 and 10.97.080, this data goes only to criminal justice agencies or the person whose record it is.
If a rap sheet contains both conviction and non-conviction entries, the releasing agency must redact the non-conviction portions before release to the public. If you believe your record contains errors, submit a Request for Modification of Record Form to the Washington State Patrol. RCW 10.97.060 sets out the conditions for deleting old non-conviction records, including specific waiting periods and no prior conviction history.
DOC Inmate Search and Sex Offender Registry
