Conviction vs. Non-Conviction Data Rules
Washington's Criminal Records Privacy Act, RCW 10.97, draws a firm line between conviction records and non-conviction data. Conviction records, cases that ended in a guilty plea, guilty verdict, or other adverse disposition, can be released to anyone under RCW 10.97.050. No restriction applies.
Non-conviction data, which covers arrests that did not result in a conviction with the case closed, is not available to the general public under RCW 10.97.080. Only criminal justice agencies and the subject of the record can receive this information. If a record mixes both types, the non-conviction portions must be redacted before any public release. This rule applies to every agency in Pacific County that holds criminal records, including the courts, the Sheriff, and city police.
If you think your own record has errors, submit a Request for Modification of Record Form to the Washington State Patrol.
