Conviction vs. Non-Conviction Data Rules

Washington's Criminal Records Privacy Act, RCW 10.97, governs what criminal records agencies can release. Conviction records, meaning cases ending in a guilty plea, verdict of guilty, or other adverse disposition, are fully public under RCW 10.97.050. Anyone can request them.

Non-conviction data is different. RCW 10.97.030 defines this as records from cases that did not result in a conviction and are no longer active. Only criminal justice agencies and the subject of the record can get this data. If a file holds both conviction and non-conviction data, the agency must redact the non-conviction parts before release.

If your own record contains errors, you can submit a Request for Modification of Record Form to the Washington State Patrol. The Criminal History Records Section reviews the challenge and corrects the record if the claim is supported. Old non-conviction records can be deleted under RCW 10.97.060, subject to waiting periods and specific conditions.

DOC Inmate Search and Sex Offender Registry
